This End User License Agreement (“EULA”) is between you and WholePath Technologies, LLC (“Quiet Sit,” “we”) and governs your use of the Quiet Sit mobile application (“App”).
License grant
Subject to your compliance with this EULA and our Terms of Service, we grant you a non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, for your personal, non-commercial use.
Restrictions
You may not:
- Copy, modify, adapt, translate, or create derivative works of the App
- Reverse-engineer, disassemble, or attempt to derive the source code of the App
- Rent, lease, lend, sell, or sublicense the App
- Remove any proprietary notices or labels from the App
- Use the App in any manner that violates applicable law
Ownership
The App is licensed, not sold. WholePath Technologies, LLC retains all right, title, and interest in and to the App, including all intellectual property rights.
Updates
We may release updates to the App from time to time. Updates may add, modify, or remove features. This EULA governs any updates, unless a separate agreement is provided with a particular update.
Termination
This EULA remains in effect until terminated. You may terminate it at any time by deleting the App from your device. We may terminate it if you fail to comply with its terms. Upon termination, you must stop using the App and delete it from your devices.
No warranty
The App is provided “as is” without warranty of any kind. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
Limitation of liability
Our total liability under this EULA is limited to the amount you paid for the App in the twelve months prior to the claim. We are not liable for any indirect, incidental, or consequential damages.
Apple App Store: additional terms
If you obtained the App through the Apple App Store, the following apply:
- This EULA is between you and WholePath Technologies, LLC only, not Apple. Apple is not responsible for the App or its content.
- Your use of the App must comply with the Apple Media Services Terms and Conditions.
- Apple has no obligation to provide support or maintenance for the App.
- Apple is a third-party beneficiary of this EULA and may enforce it against you.
Google Play Store: additional terms
If you obtained the App through Google Play, your use is also governed by the Google Play Terms of Service.
